RIM banned from selling BlackBerry in the US

BlackBerry PDA maker Research in Motion (RIM) has been banned from sale
of these products in the United States, and although the case of infringement of RIM patents of the holding
NTP suspended on appeal, court ruled in favor of NTP.
Decision to ban the sale, production of PDAs, software or the provision of services
RIM is in effect in the United States until the expiration of the NTP patents that
were violated – and the most recent of them expires on May 20, 2021.

Both parties, RIM and NTP, began litigation in 2021 when the holding said,
that Research in Motion infringes the first radio frequency patents
wireless e-mail systems. As you know, the BlackBerry service,
Software and hardware developed by the company allows their owners to send
or receive information via handheld devices in wireless networks.

Jim Wallace of Wiley Rein & Fielding, representing the NTP in court, stated:
“The situation for RIM will develop in this way – if the appeal
will not be satisfied “. Wallace said NTP will continue to issue licenses,
including exclusive, to PDA manufacturers, however, comments on the cost
no licenses were given. By the way, RIM, nevertheless, will not be excluded from the list of companies,
who can apply for licenses.

Henry Bansow, representing RIM in court, said in turn that the company
plans to seek re-examination of NTP patents by the Patent Commission and
trademarks of the United States, adding that at least the cross-checking of patents and
appeals can take several years, the company is confident in resolving the issue in its
benefit.

RIM currently has 30 days to appeal and, according to Bansou,,
the final decision will be made by the court in a year. As the analyst at ThinkEquity notes
Partners, Jason Tsai, “NTP will not benefit from RIM’s” oxygen cutoff “since the holding’s business is licensing … Most likely RIM will pay
nominal royalties and although this will have a short-term negative
effect … in the future, negative consequences will be minimal “
